FAQ About Social Security Disability Hearings, Pt. 3

Will I have to fill out any forms before my Florida Social Security disability hearing?

Yes. The administrative law judge will usually send you forms asking about your current medical treatment, such as what medications you are taking. The judge wants to base his or her decision on the most up-to-date medical information available. As with all forms, after completing these forms, you should send them to your Ocala disability lawyer first, and not to the judge directly.

Should I try to find witnesses for my Social Security disability hearing?

Yes. Though you will be testifying at the hearing on your own behalf, it can also be helpful to have someone else provide an extra perspective on how your disability has effected your life. This should be someone who knows you well and can describe your activities before and after your disability. It should also be someone who can express him- or herself well in front of a judge.

The most common witnesses are spouses, family members, or close friends. These witnesses are good because they are probably in the best position to observe how your disability has affected your life. However, a judge will sometimes think that such witnesses aren’t entirely reliable because they are so close to you that their testimony will be shaped by their desire to help you win benefits. If possible, consider calling a witnesses who might be more objective, such as a former coworker, a landlord, a minister, or a neighbor.

Should I have friends and family write letters about my disability?

Yes. Letters can be very useful, and as a general rule, the more letters, the better. Your Ocala disability lawyer can provide you with instructions to give to your friends and relatives about how to write an effective letter.
